A public hearing will be held by the City of Portland Planning Commission for the purpose of receiving comments on amendments to the following Sections of the City of Portland Zoning Ordinance:
Addition of a Section 42-318 to Article IV “Supplemental Regulations” of the Zoning Ordinance which is Chapter 42 of the City of Portland Code of Ordinances. The purpose of this ordinance is to regulate the use of land for small wireless communications facilities in conformance with the small wireless communication facilities deployment act, Act No. 365 of the Public Acts of 2018. In doing so, the City of Portland wishes to ensure the reasonable and fair control and management of public rights-of-way, support new technology, avoid interference with right-of-way use, and protect the public, health, safety, and welfare.
The Ordinance will, among other things, set forth the zoning procedure for various small wireless communication facility applications, provide the fee amounts applicable, provide zoning criteria for review, and authorize various design criteria to be published.
Comments or questions can be addressed to the City Manager at the City of Portland City Hall during normal business hours at 517-647-2931. There will be an opportunity for public comment on the request at the public hearing.
